The draft Hong Kong/Indonesia ASA contains a note to the
effect that points in the PRC may not be served (Annex Note
4). Why is this?
Section IX of Annex I to the JD provides that Hong Kong
ASAS may only regulate services which do not operate to,
from or through the mainland of China. The note in question
is consistent with this provision in order to ensure
continuity of the ASA after 1997. Thus it
it will not be
possible for an airline of Indonesia to operate a service
to Hong Kong via an intermediate point in the mainland of
China, or as a point beyond Hong Kong, before or after 1997
under a Hong Kong/Indonesia ASA. A similar restriction must
therefore appear in all other Hong Kong ASAS. We hope that
our position on this, which is non-negotiable, will not give rise to any practical difficulties for Indonesia, particularly as the existing UK/Indonesia ASA does not
provide for such services. In any case,

combine Hong Kong with а mainland point, because of
cabotage implications post-30 June 1997.
Why agree a separate ASA now with over six years before
Hong Kong reverts to the PRC?
There are still a number of ASAs to be separated and it is
the wish of both the British and Hong Kong Governments to
have the new ASAS in effect some time before 1997 so that
can be resolved well before
any unexpected difficulties
that date.
