Re: International Convention for Safe Containers 1972

Your memorandum reference DGO 371/1 refers.

There is in force in Bermuda the Freight Containers (Safety Convention) Regulations 1986 (B.R. 10/86) which were made by the Minister

the Minister of Labour and Home Affairs under our Health and Safety at Work Act 1982. I gather from the Principal Marine Surveyor that in 1989 he sent a copy of our Regulations to the Department of Transport, London, for forwarding to the Foreign and Commonwealth office for their use in drafting suitable regulations for Hong Kong. Nonetheless, I am enclosing herewith a copy of the Regulations.

For the enforcement of the Convention, the Minister of Labour and Home Affairs has designated the office of Principal Marine Surveyor

to be authorized

to

issue approvals for containers.

For the testing, inspection, approval and maintenance of containers, which are referred to in Article IV of the Convention, the position is

is as follows. No containers are manufactured in Bermuda so approval of containers manufactured overseas and which are registered in Bermuda falls within Article IV paragraph 3, whereby approval may be made to any Administration of any contracting party.

Containers manufactured overseas are invariably certified the principal Classification Societies such as Register of

of Shipping or the American Bureau of Shipping. National Authorities do not get involved in the certification of containers.

The system we use in Bermuda to keep track of containers registered under the BDA designation is to require owners of containers to supply a list of all containers. This comes in the form of a microfische,
