incorporated in Hong Kong, or if an individual, be

ordinarily resident in Hong Kong.

Charters

3.17.

There are a number of types of charters of

vessels; charters by demise will have to be considered in

particular in the context of a new shipping register.

The charterer in a charter by demise in effect manages

and controls the vessel even though the ultimate legal

title remains with the registered owner. The ship will

be entitled to remain registered in Hong Kong, legal

sanctions in respect of any contravention of the

requirements of registry being available to the Hong Kong

Government.

3.18.

Even though 'Management and Control' of the

ship itself will not be required as a criterion for

registration, the genuine link will thus be firmly

maintained between the ship and Hong Kong.

3.19.

A large proportion of the ships at present

registered in Hong Kong are in fact chartered by demise

to interests outside Hong Kong.
