the 250 or so yachts registered in Hong Kong, many of
which would not comply with the proposed criteria for
registry.
Management and Control
3.13.
In our view the ownership of a ship on the Hong
Kong Register is the most important aspect of the genuine
link. But it is important that ownership should be by
something more than a "brass plate" company. Something
far more positive will be required. For this reason the
CD suggested that management and control of the ship
should be exercised from Hong Kong. The CD did not
elaborate exactly what this would mean and we received
few comments on it.
3.14.
As far as we have been able to determine,
actual management and control of a ship itself is not a
concept adopted with regard to any other shipping
register. In practice similar ends have been achieved in
a number of countries through concepts which relate, on
the one hand, to the requirement that the principal place
of business of the shipowning company should be in the
country of registration and, on the other, to the
appointment of permanent representatives in the port of
registration.
