Thank you for your letter of 12 April 1991 which has been passed to me by the office of the Commander-in-Chief Naval Home Command.

I am sure you are aware that with the creation of the new Hong Kong Shipping Register, it is now a matter of Hong Kong law that all vessels registered there are required to wear both a Red Ensign and the Hong Kong colony ensign.

My initial thoughts on this matter would be that this requirement along with the suspension of Section 73 of the Merchant Shipping Act will render any vessel on the new register ineligible to wear any ensign other than those named above.

I will, however, write to you again when I have received further advice on the implications of the new legislation.
