1. I have received a very helpful minute from Miss Brooks dated 30 July, commenting on Hong Kong telno 2223 and suggesting a way forward on this problem (papers attached). I think I should now write to the Department of Transport along the lines proposed as amended by Miss Brooks, and that we should then pursue the option of a Admiralty Warrant.

2. We should, however, first check the point raised in para 3 of Miss Brooks' minute. If indeed the other DTS do not have anything similar to Section 73 of the Merchant Shipping Act 1884, then the option of the Secretary of State exercising his power under Section 78 of the Merchant Shipping Act 1906 is still a possibility.

3. Do you have the answer to this point? If not I should be most grateful if you could ask the DTP whether they can answer it. As a last resort, we should consider asking the DTS themselves, though I imagine this might be a time-consuming process.
