Council may by-pass the Nominating Committee, after the legislative amendment to abolish voting by proxy at Council elections has been passed. The Administration has yet to determine its stance in relation to the SFC's recommendations.

Since the SEHK may appeal to the Governor-in-Council against the issue of a Restriction Notice, Members are invited to simply note the contents of this memorandum and to refrain from discussing or making comments on them at this stage, lest the impartiality of the Council as the appellant body be open to challenge.
