APPLICATION TO HONG KONG AFTER 1997 OF PRIVATE INTERNATIONAL
LAW TREATIES
1.
Thank you for your helpful and prompt letter of
10 September in response to mine of 9 September. I have now received from Hong Kong the remaining two papers, covering four further treaties:
(a) Convention on the Law of Trusts (Hague 1984)
(b) Protocol on Arbitration Clauses (Geneva Protocol 1923)
(c) Convention on the Execution of Foreign Arbitral Awards (Geneva Convention 1927)
(d) Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York Convention 1958)
2. On (a), you will see from the enclosed papers that the Chinese have already agreed to the principle that the Convention should continue to apply after the 1997 handover. The other three treaties have been covered in one paper. I should be most grateful once again for my any comments you or Jill Barrett (FCO legal advisers) may have on these papers.

The Hong Kong Government have also asked some questions which I think are best addressed to FCO Treaty Section. They have asked for copies of the UK's ratification of the Hague Convention on the Law of Trusts (on 17 November 1989) and the extension to Hong Kong (on 30 March 1990). I should be most grateful if Pat Martin could supply copies of these.
