Illegal Traffic

Any transboundary movement of hazardous wastes or other wastes shall be deemed illegal traffic, if carried out :

a)
without notification pursuant to the provisions of this Law;
b)
without the consent required under this Law;
c) with consent obtained though falsification, misrepresentation or
fraud;
d)
not in conformity with the documentation laid down by this Law and the rules and regulations promulgated by the Regulatory Authority;
e)
in contravention to any other rule or obligation set out in this Law
A person shall be deemed to commit a crime under this Law if:
a) He actually does the act or makes the omission which constitutes
the crime.
b) He does or omits to do any act for the purpose of enabling or aiding any other person to commit the crime

The person found guilty of a crime under this Law shall be punishable by
Any carrier used in the transportation, importation or export of illegal hazardous wastes or other wastes and any land on which such wastes are deposited or dumped shall be forfeited in favour of the Government.
