In summary it appears that the deficiencies in the law are likely to mean that China's adherence to International Conventions could be significantly delayed and would not in practice satisfactorily establish the level of protection afforded to foreign works and sound recordings. In my view therefore we should be looking to initiate early discussions on a bilateral agreement. I would not be inclined to involve the Community at this stage: we have more to gain than any other Member States and, I believe, something approaching a special relationship with China in this field. I would however welcome others' views on this and am therefore copying this letter to Peter Millett in UKREP as well as to the recipients of yours.
