2. The supreme judicial organ of the State makes interpretations concerning questions of the concrete application of the law in the process of using the law. This kind of interpretation is usually called Judicial interpretation'.

The first is Court interpretation that is to say the Supreme People's Court makes interpretations on concrete questions concerning the law that arise in the process of judgements in the People's Court. The other sort is Procuratorial interpretation and in this case,

the Supreme People's Procuratorate makes interpretations of concrete legal questions that arise in the course of procuratorial work by the People's Procuratorate. The special characteristic of judicial interpretation in our country is that interpretative power can only be exercised by the supreme judicial organs. Local People's judicial organs do not have the power to make judicial interpretation. This is mainly in order to guarantee that laws are applied uniformly within the whole country and to protect the authority and stability of the law. At the time judicial interpretation can only be made on concrete questions of the law that arise in

the case of Court or Procuratorial work. They cannot at will change the regulations laid down in the law or the intention of the legislature and they cannot be in contravention of the Constitution and the Laws. If there appear contradictions between interpretations made by the Supreme People's Court Supreme People's Procuratorate they can be referred to Standing Committee of the National People's Congress interpretation and resolution.

3. The highest executive organ of the State that is the State Council and its main departments can make interpretation and these are called administrative interpretations. They include 2 main types. The first is interpretations made on the concrete application of the law which concern laws not dealt with by the Courts or Procuratorial work; the second is the interpretation of administrative regulations decided upon by the State Council in the exercise of its power made by the State Council and its main departments. These two types of interpretation both have legal force, but they cannot be in contravention of the Constitution and the Laws.

4. Local organs of state power have interpretative power over local regulations. There are 2 types of interpretation. The first are interpretations of regulations produced by the Standing Committees of the People's Congresses of provincial level bodies concerning necessary clarifications or supplements to the text of local regulations; the second, is interpretation concerning the concrete application of local regulations made by the People's Governments of provincial level units.
