When our country was drawing up the basic law of the Hong Kong SAR it first grasped the principle of state sovereignty over the Hong Kong region in order to ensure national unity and integrity. This was the basic principle of putting into practise `one country two systems'. Ours is a single unitary socialist state and is not a federal state. Our country has but one highest organ of state power that is the National People's Congress, one highest organ of government power that is State Council and the Central People's Government and one Constitution - that is the Constitution of the PRC. The special administrative regions in our country are local administrative regions; they are not components of a Federal Republic. They are directly under the Central People's Government. Clear evidence of this is that: defence and foreign affairs, which are the most important manifestations of the State Sovereignty, remain under the responsibility and unified management of the Central People's Government; the Basic Law of the Hong Kong SAR was decided and promulgated by the NPC on the basis of the Constitution and it regulates the system to be in practice in the Hong Kong SAR; no regulations decided upon by the legislative organs of the Hong Kong SAR can be in conflict with the `Basic Law'; all powers that the Hong Kong SAR enjoys are delegated to it from the centre.
At the same time as grasping this basic principle of grasping state sovereignty and maintaining national unity in the course of legislation we must also pay due attention to the needs of `two systems' and enable the Hong Kong SAR to enjoy a high level of autonomy which reflects the facts of the special policies which our country has adopted towards the Hong Kong SAR which are not absolutely the same as those for the rest of the country. This is to say that although the Hong Kong SAR Government is a local government
it nonetheless enjoys considerably greater powers than all other local governments in the country.
The main evidence for this is that the Hong Kong SAR enjoys the power of administration, the power of legislation, the power of an independent judiciary, and the power of final judgement.
ii. The development of the capitalist economy in Hong Kong must be correctly integrated with the development of socialist construction in the rest of the country.
