Delete subsection (1) and subsection (2) and replace them with a new section 9 which reads:
119.
No prosection for an offence under this Act shall be instituted except by or with the consent of the Attorney General of Hong Kong.".
In subsection (1) paragraph (a) add "not
exceeding $500,000" after the word "fine" and
before the words "or both".
In subsection (1) paragraph (b) delete the words "the statutory maximum" and replace them with "$50,000".
In subsection (2) delete the words "level 5 on the standard scale" and replace them with "$20,000".
Delete subsections (1) and (2).
Replace subsection (3) by a new subsection (3) which reads:
"(3) Section 9(1) of the Official Secrets Act 1911 (search warrants) shall have effect as if references to offences under that Act included references to offences under any provision of this Act other than section 8(1), (4) or (5).".
In subsection (5) replace the words "any place in the United Kingdom" by the words "in the High Court in the exercise of its criminal
jurisdiction, in the District Court or in a magistrate's court.
