THE PROBLEM
Legislation is needed to turn Radio Television Hong Kong (RTHK) into an independent but government-funded public broadcasting corporation with a Board of Governors.
RECOMMENDATION AND ADVICE SOUGHT

Members will be asked to advise whether the Radio Television Hong Kong Corporation Bill 1991 (both English and Chinese) at the Annex, should be introduced into the Legislative Council.
BACKGROUND AND ARGUMENT

On 18 July 1989, after considering memorandum XCC(89)100 [at Annex A of memorandum XCC(91)142], the Council ADVISED and the Governor ORDERED that -
(a) Radio Television Hong Kong (RTHK) should be turned
into a public broadcasting corporation;
(b)

the RTHK Board of Governors should be responsible to the Governor for running RTHK in accordance with policies approved by the Governor in Council and embodied in legislation and the Board should comprise only non-official members. The Chairman and members of the Board should be appointed by the Governor;
RTHK should be funded by means of a one-line discretionary subvention which would take into account income generated by RTHK itself and would be subject to the voting of funds by the Legislative Council. The Policy Secretary concerned should be the Controlling Officer for the subvention;
