(c) has become incapacitated by physical or mental

illness;

(d) has ceased to be ordinarily resident in Hong Kong;

(e)

has during his term of office been convicted of a

criminal offence for which the sentence is fixed by

law or that is punishable by a term of imprisonment

of 5 years or more; or

has wilfully failed to declare any pecuniary

interest, whether direct or indirect, which he has,

or any personal interest greater than that which he

has as a member of the general public, in any matter

under discussion at a meeting of the Board or a

committee established under paragraph 9,

the Governor may terminate his appointment.

(4) Notice of any termination under subparagraph (3) shall be

published in the Gazette.

(5) Where any member of the Board resigns or the office of any

member otherwise becomes vacant before the expiry of his period of

appointment, the Governor may appoint another person to hold office

until the expiry of the period for which such member was originally

appointed.

Chairman and Vice-Chairman

The Governor shall appoint

a member of the Board to be the Chairman of the

Board; and
