subsection (1) the Corporation may at its own discretion broadcast
or otherwise publish the contents of such notice.
43.
Letter of admonition
(1) Subject to the provisions of this section, the
Broadcasting Authority may where it is satisfied whether following a
recommendation of the Complaints Committee under section 11 (4) (d) of
the Broadcasting Authority Ordinance (Cap. 391) or otherwise that a
programme provided or produced for broadcasting by the Corporation
has contravened any relevant Code of Practice issue a letter of
admonition to the Corporation in respect of the contravention, and
such letter shall state the reasons why it has been issued.
(2) Except where a letter of admonition is issued following a
recommendation of the Complaints Committee, the Broadcasting
Authority shall not issue a letter of admonition to the Corporation
under subsection (1) unless and until it has given the Corporation
(a) notice in writing stating that the Broadcasting

Authority has under consideration the issue of such a
letter of admonition and the grounds upon which and
any other reason why such a letter of admonition is
being considered; and
the opportunity of making representations or
objections concerning the letter of admonition under
consideration.
(3) The notice referred to in subsection (2) (a) shall, in
addition to stating the matters required by that subsection, state
that representations and objections relating to the proposed letter
of admonition shall be made to the Broadcasting Authority (either
