If, after MOD or HQ I of R confirmation of apparent ineligibility, an enquirer persists or where there are circumstances so exceptional as possibly to warrant a relaxation of the stringent rules at paras 3 to 7 above, a full report on the case is to be submitted to R2b(RAF) for evaluation. A completed F/Sy/904 (single copy) may be used and reference should be made in a covering letter to the reason for the report and any other relevant factors, eg nationality problems, Crown connections, special skills and, if possible, the quality of the candidate.

10. When MOD does not approve continuation with the case, a letter in the form of CIS 7-5 is to be sent to the enquirer. If authority is given to take an application, such authority does not constitute a waiver of the Residence Rule but simply gives approval to proceed with the case, and, if appropriate after completion of the selection process, to submit an application to HQ P&SS(UK) for the necessary waiver in accordance with normal procedures.

METHOD OF APPLICATION

UK-Born Applicants.

An application for waiver of the residence rule in respect of a candidate born in the UK is to be submitted on F/Sy/904, completed in accordance with the instructions contained in Annex A, to HQ P&SS (UK). The following additional information is required.

2. The details of the overseas residence should be entered on Appendix 2 to Annex C to Siro 7 which is to be attached to the F/Sy/904. The F/Sy/904 should be endorsed in Red Ink 'PV(S)/RES CLEARANCE FOR THE TRADE OF....

b. Two references (FS MOD 484), to cover the period of overseas residence, should be obtained by the CIO and submitted with F/Sy/904. These may be school or employment references, or should be from persons of good social standing who were living in the overseas country at the time of the applicant's residence there.

C.

An application for a waiver of the residence rule in respect of a candidate with no UK residence is to be accompanied by a covering letter, signed by the Office Cdr, detailing the basis on which the candidate qualifies for special consideration, eg what are the "strong" Crown connections or what "special skill or experience" is being offered. If available, the application should also be accompanied by a letter from an Air or Defence Advisor.

Non UK-Born Applicants. In addition to the requirements at para lla end l1b, a non UK-born applicant should complete a "Persons of Non-UK Origin or with overseas Connections" Form in accordance with the guidance given at paras 24 to 26 of Annex D.
