When the Overseas Pensions Department of the ODA first considered the points raised in Mr Waters' letter of 19 June, their initial reaction was that it should not be necessary to localise sections 38 and 39 of the Superannuation Act 1965. However, they wished to consult their Legal Advisers before confirming this. The ODA have told me that their Legal Advisers still have the papers but assure me that they will let us know the outcome as soon as possible. I am sorry not to be able to be more helpful.
