3. Modification proposals in respect of Injury on Duty

benefits (additional pension), death benefits (dependants

pension) and employees compensation.

A. Eligibility criteria for receiving dependants pension

and additional pension will be amended along the lines of

those stipulated in the Employee Compensation Ordinance.

Unless it can be proved that injuries or death of the civil servants is caused wilfully by the civil servant through gross negligence, otherwise he is eligible for additional pension or dependants pensions.

B.

Amendments to provisions in respect of beneficiaries of

dependant pensions and the terms of payment. Definition of "dependant" can be more flexible, under certain special

circumstances, the Secretary for the Civil Service may exercise discretion in accepting those who originally do not meet the definition for a "beneficiary" as a dependant pension beneficiary, depending on his/her financial

dependence on the deceased civil servant.

Remove the discriminating requirement that a male officer must prove that he is financially dependant on a deceased female before he can receive dependant pension.

Remarried spouses of deceased civil servants may continue to receive dependants pension until death.

C. It is proposed that an additional option will be given to a beneficiary of dependant pension. A one-off lump-sum commuted dependant pension is allowed to replace dependant pension paid on a monthly basis. The commuted amount at the date of payment is equal in value to the commuted monthly dependant pension.
