(b) (i) Where a public body or a body of persons (whether corporate or unincorporate) has not, apart. from this paragraph, a power necessary to enable it to make an agreement with the Authority which, if made, would be an agreement described in paragraph (a), it shall, by virtue of this paragraph, have that power.
(i) This paragraph shall not. be construed as applying to
trustees of a charity.
9. Delegation and sub-delegation of Authority's functions
(1) Subject to subsection (2), the Authority may delegate any of its functions, other than its power under section 15 or its power under this section to delegate, to-
(a) any member (including the Chairman) of the Authority, or (b) the Chief Executive Officer or any other of its employees. (2) (a) A delegation under this section shall not prevent the concurrent performance by the Authority of the function delegated.
(b) The Authority may revoke a delegation under this section.
(3) Where the Authority makes a delegation under this section, it may at the same time authorize the person to whom the delegation is made to sub-delegate the function delegated and such authorization may contain restrictions or conditions as regards the exercise of the power to sub-delegate under the authorization.
(4) Where any person purports to act pursuant to a delegation or sub-delegation under this section, he shall be presumed, until the contrary is shown, to be acting in accordance with the terms of the delegation or sub-delegation.
10. Annual report of Authority
The Authority shall, as soon as practicable after the end of each financial year, prepare a report on its activities during that financial year and send a copy of the report to the Governor and a copy thereof shall be laid on the table of the Legislative Council.
11. Financial year
The second and each subsequent financial year of the Authority shall be the period of 12 months beginning on 1 April in any year and its first financial year shall be the period beginning on the day on which the Authority is established and ending on the following 31 March.
