GCC Clause 41(1) and 53(3) (b) (iii) are attached.

The Amendment Ordinance stipulates that the employer of a person who is an illegal immigrant on a construction site is liable to a fine of $250,000 and to imprisonment for 3 years. The objective is to prevent employment of illegal immigrants as site workers.

The essence of paragraph 5 of the Instructions to Tenderers which bears most relevance to this 'Labour' clause reads as
follows
"These Instructions to Tenderers and the documents referred are for the purpose of guidance only. Such documents and any other documents containing information or minuting discussions in relation to aspect of the Tender or the Project shall not form part of any contract subsequently concluded between Government and the Tenderer, nor be used in interpreting or construing any such contract, and neither Government nor its agents shall be responsible in any manner whatsoever for any representation or information contained therein."

Similar Clauses on 'Labour' will be included in Instructions to Tenderers for other ACP contracts.
