BCCI: INQUIRY BY LORD JUSTICE BINGHAM

We spoke about your minute (undated) which attached a letter of

4 September to the PUS from the Secretary to the Bingham Inquiry.

As far as I am aware,

I am aware, the only DTS where BCCI had any involvement were Cayman Islands, Hong Kong and Gibraltar. If the Bingham Inquiry wishes to approach DTS other than the Cayman Islands

then I agree that the same procedure should be followed as for the Cayman Islands. This means that the initial approach should be made

to the Governor of the territory concerned channelled through the

FCO.

It would be for the Governor to decide, if necessary in consultation with the FCO, the appropriate channel for further approaches. In the case of Gibraltar, for example, it might perhaps be appropriate for the Inquiry to correspond direct with the Financial Services Commissioner. But it would be important for the the Governor (and thus the FCO) to be kept fully informed about what
