USE OF FORCE AND FIREARMS

Use of Force

A Police officer shall display self-discipline and exercise a high degree of restraint when dealing with the public and shall not resort to the use of firearms unless such action is clearly necessary and he is unable otherwise to effect his lawful purpose.

2. When circumstances permit a warning shall be given of the intention to use force and of the nature and degree of force which it is intended to use. Persons shall be given every opportunity to obey Police orders before force is applied.

3. The principle governing the degree of force which may be used by a Police officer to achieve an object is that only the minimum force necessary may be used to achieve the object; once the object nas been attained the use of such force shall cease.

Under no circumstances may force be used by a Police officer as a punitive measure.

5. If a Police officer uses unjustifiable force he is liable to criminal or civil action as would an ordinary citizen; he may also be subject to disciplinary proceedings.

Use of Police Firearms

For the purposes of this order "firearms" in its reference to Police weapons means all Force firearms but excludes grenades and Aerosol CS Irritant Projectors.

2. A police officer shall not draw a firearm from a holster, or present any firearm by pointing or aiming unless he would be justified in using it in accordance with this order. Provided that a police officer may draw his revolver as a precautionary measure when he has good grounds to believe he may be justified in using it in accordance with the provisions of paragraph 4 of this order. This order does not apply to police officers handling firearms in the course of reporting on or off duty, or maintaining firearms or for training purposes.

3. When an incident occurs in a crowded street or enclosed area or any other place where it is probable that an innocent person will be injured, a firearm shall not be used by a Police officer.

4. A Police officer may discharge a firearm:

(a) to protect himself or any other person from death or serious

bodily injury; or

(b) to effect the arrest of any person who he has reason to believe has committed a serious and violent crime;
