HONG KONG CIVIL SERVICE AND JUDICIARY: APPROVAL OF

APPOINTMENTS, PROMOTIONS ETC

Problem

1.

Whether, with a view to 1997 and to efficient use of

resources, we should streamline procedures for Hong Kong civil service appointments, transfers, promotions, disciplinary action etc, so that the Secretary of State's approval is required for only the most senior posts?

Recommendation

2. I recommend that:

(a) the Secretary of State's approval should be required only for the positions listed at Annex A, equivalent to those listed in Articles 48 (5) of the Basic Law, together with the Chief Justice and Judges of the High

Court;

(b) disciplinary proceedings should be referred to the Secretary of State only in the case of these posts at

Annex A and of other officers whose appointment was originally made or approved by the Secretary of State;

(c) retirement on medical grounds should be a matter for

the HKG;
