CHAPTER II TERMINATION OF SERVICE

Retirement on invaliding

In accordance with the provision of Section 6(e) or Regulation 26(4)(c) of the Pensions Ordinance and Regulations (Cap. 89), an officer may be retired from the public service if medical evidence is provided to the satisfaction of the approving authority that he is incapable by reason of any infirmity of mind or body of discharging the duties of his office and that such infirmity is likely to be permanent. An officer's service is not usually terminated on account of ill-health if there is definite prospect of his being able to perform his duties satisfactorily within a reasonable period of time, after receiving medical treatment and being granted sick leave where necessary in accordance with Civil Service Regulations 1220 1249.

Retirement of non-directorate officers on invaliding may be approved by a Head, Deputy Head or Assistant Head of Department or General Grades, as appropriate.

The authority for approving the retirement of directorate officers on invaliding rests with the Secretary for the Civil Service.

The invaliding of an officer holding an appointment which is subject to the approval of the Secretary of State requires the covering approval of the Secretary of State.
