(5) The returning officer at the counting station who has

adjourned the original count by a declaration under

subregulation (1) shall, in the presence of such persons as may

be present in the counting station -

(a) cease the original count; and

(b)

deposit the opened and unopened ballot boxes

together with the ballot papers (whether counted or not), the unused ballot papers, the spoilt ballot papers, any tendered ballot papers, any ballot paper accounts and any verifications

thereof and any other relevant election

materials in a safe place within the confines of

the counting station or, in the absence of any

such safe place within those confines, in a safe

place within the confines of a police station or

some other public building or, in the absence of

any such police station or public building, in

the confines of some other secure building

(including a residential building) in the

vicinity of the counting station.

(6) The opened and unopened ballot boxes together with the ballot papers, the unused ballot papers, the spoilt ballot papers, any tendered ballot papers, any ballot paper accounts and any verifications thereof and any other election materials referred to in subregulation (5) shall remain in the charge of the returning officer (who shall be responsible for the safety and security of the same) until the counting of the votes in respect of the adjourned count commences.".
