PARAGRAPH 58 OF THE IMMIGRATION RULES: MR AU YEUNG
Vivienne Dews wrote to you about the issues raised by this case on 1 Augusť. I am writing to let you know that the Immigration Service has been able to trace some details about this case, which very much tend to confirm what Vivienne surmised in her letter.
When Mr Au Yeung arrived at Heathrow Airport on 12 June, the Immigration Officer noted on the reverse of the landing card that Mr Au Yeung sought entry for 2 weeks to visit his sister; that he had 2 weeks leave of absence from his employment as a civil engineer in Hong Kong; and that he had a return ticket and £500. The Immigration Officer was aware that Mr Au Yeung had previously been resident in the United Kingdom. He granted leave to enter as a visitor for 6 months until 12 December 1990.
As you will see, this record accords with Mr Au Yeung's Own account of his short interview with the Immigration Officer. The few standard questions which the Officer asked clearly established that Mr Au Yeung was seeking admission as a visitor for 2 weeks only and had no intention of resuming residence in the United Kingdom. Accordingly the
the Immigration Officer's decision to grant Mr Au Yeung leave to enter as a visitor was perfectly correct; indeed there was no basis on which he could conceivably have reached any other decision. The way in which this case was handled was not in any way inconsistent with the assurance given by the Home Secretary on 15 May, as Mr Au Yeung was plainly seeking admission as a visitor and not as a returning resident.
