International Covenant on Civil and Political Rights
(ICCPR) as applied to Hong Kong (on which the Bill of
Rights is based) "shall remain in force and shall be implemented through the law of the Hong Kong Special
Administrative Region". Entrenchment will be achieved
before 1997 by an amendment to the Letters Patent. Thus
both before and after 1997 no Hong Kong legislation will be able to contravene the provisions of the ICCPR, as applied to Hong Kong.
Mr Hope also refers to the prosecution in Hong Kong of certain individuals under the Summary Offences
Ordinance. It is for the Hong Kong Government to handle
these cases in accordance with Hong Kong law. The cases
are still subject to appeal and are therefore
sub judice.
