Because each application will fall to be treated on its merits it is important that applicants should be aware that a successful application will be the exception rather than the rule. If asked directly, you may confirm that a rejection does not preclude the applicant from applying again.

7. The guide issued with the application form B advises people who think they may qualify to write in the first instance, stating thei case, to the Governor of dependency concerned.

At this stage, you should consider the se in the light of the guidance above and form a view as to the likelihood of the application succeeding. If in your opinion the case_does not meet the criteria, you should inform the person concerned of your views in a way appropriate to the case. If in your opinioh (and bearing in mind the exceptionall; stringent criteria) the application is suitable for consideration, the person should be advised to make a formal application. This should then be accepted, with the fee, and forwarded to the Hom Office with your observations. If you receive a formal application from someone who has not made preliminary enquiries, you should check that the person is technically eligible to apply under the provisions of the BNA 1981 before accepting the application and forwarding it with the fee to the Home Office. Each application should be accompanied by a statement of your views so that the Home Secretary may take local knowledge into account in reaching a decision on the application.
