Dear Sir,

I refer to your letter dated 15 May 1990 to the Governor and am authorised to reply to it on the Governor's behalf.

To apply for naturalisation as a British Dependent Territories citizen under Section 18 (1) of the British Nationality Act 1981, you have to fulfil, among other things, the residential requirements as stipulated in the First Schedule to the Act. Please refer to the attached information leaflet ID 27A for the details regarding the residential requirements. Since you have been away from Hong Kong for eight to nine years, it is apparent that you could not fulfilled the statutory residential requirements for naturalisation.

Nevertheless, if you feel that there are special circumstances in your case satisfying the waiver of the residential requirements, you should provide the periods of your absence from Hong Kong in the last five years together with adequate supporting evidence relating to your job assignments overseas to the Director of Immigration for consideration. In this connection, you may write to Mr Eddy TSUI, the officer-in-charge of the Naturalisation and Nationality Section at 2nd Floor, Wanchai Tower II, 7 Gloucester Road, Hong Kong for more detailed advice as to how to file an application.

You may wish to note that the grant of

naturalisation is a privilege, not a right, and that naturalisation is granted at the discretion of the Governor who had delegated such function to the Director of Immigration. In the special circumstances of a particular case as the Director of Immigration thinks fit, the need to fulfil certain residential requirements may be waived. However, there is no provision to waive the requirement that you must have been in Hong Kong at the beginning of the five year period ending with the date of the application.
