Under section 3 (1) of the Act the Governor may make regulations with respect to the manner in which applications are to be made. The British Nationality (Hong Kong) (Recommendations for Citizenship) Regulations 1990 will set out the method of application, the time limit for returning applications, the application forms, the fees for application and registration and other related matters. A copy of the latest draft Regulations is at Annex C. The Regulations, being made under a UK Act by the Governor, do not require approval by the Legislative Council.

The British Nationality (Hong Kong) (Registration of Citizenship) Regulations 1990, will be made by the Secretary of State under section 41(1) of the British Nationality Act 1981.

These regulations for registration are required to accommodate the special selection procedures of the scheme which apply specifically to Hong Kong. The Regulations are straight forward and should not create any controversy here or in the UK.

They will be tabled in Parliament after being made. A copy of the draft is at Annex D.

British Nationality (Miscellaneous Provisions) (Amendment) Bill 1990

The British Nationality (Miscellaneous Provisions) (Amendment) Bill 1990, which Members approved on 3 July 1990, has been designed to prevent applicants from making false statements in connection with the British nationality scheme and to provide for the preservation of confidentilaity of information relating to the identity of applicants. Resumption of the debate on the Second Reading and Third Reading of the Bill have been re-scheduled for 17 October.
