Loss of right of abode in Hong Kong

I am glad you agree with us that provision should be made in the Bill for BDTCs who are granted British citizenship to be deprived of their BDTC status before 1997. Your concern that some individuals might lose their right to live and work in Hong Kong as a result is fully appreciated and has been looked into.

In accordance with the terms of the Joint Declaration, HKG will in any event have to introduce Hong Kong legislation before 30 June 1997 to enable persons who are not of Chinese race to acquire a right of abode in Hong Kong.
In that legislation, we see no great difficulty in providing for the preservation of the right of abode in Hong Kong for persons deprived of their BDTC status under the Bill.
would however suggest that to avoid any temporary loss of right of abode, the Bill should provide for the deprivation of BDTC status to take effect on a date to be specified by the Secretary of State. The date will then be specified once our local legislation is in place.

We believe that reference to the ISCO should enable us to defend the inclusion of various occupations in their respective occupational groups. ISCO classifications serve many purposes. They are determined on the basis of similarities with respect to certain attributes. Different views always exist on what attributes should be included and how much weight should be attached to each attribute. For the purpose of this exercise, we have made further groupings based on the "building blocks". As there are likely to be questions raised on the occupational groups, I agree
with you that a defensive brief should be prepared. It will be provided as soon as we have a firm decision on which occupations have been included in the GAS.

The last paragraph of Jeremy Page's note attached to your letter of 13 March is accurate. The example cited is fine if clerks have been included in GAS. If not, another more appropriate example should be given. An alternative is at Appendix I.
