In addition to the square bracketed material, we shall also
need more information about
(a)
(b)
judicial review in Hong Kong;
the rights of British citizens to live and work in Hong
Kong under local immigration law. Clearly, we should
not register 50,000 HK BDTC's as British citizens and
then discover that they have thereby lost their automatic
right under local law to live and work in Hong Kong.
You said you would pursue this in Hong Kong.
Although I do not think we need trouble the Law Officers with
the general package of proposals, it would, in my view, be prudent
to consult them in relation to whatever provision is included to
deal with the exclusion of judicial review (given that the Law
Officers have given advice in the past to the Prime Minister about
the difficulty of producing legislation which excludes the
jurisdiction of the courts).
