In both articles the State is the guarantor of rights and freedoms. The special responsibilities of the State in respect of the protected rights is explained by the social nature of the rights regarding marriage and the family and by the fact that the rights of children are enjoyed only in a condition of dependency. In the context of the Bill of Rights the State which has the obligations in respect of these rights is the state of which Hong Kong forms a part.
