Having regard to these views, we do not recommend any exemption to the ICAC and law enforcement agencies.

Review of legislation

In June 1989 we began a review on policies, practices and legislation that may not be consistent with the ICCPR. As a result we have identified a number of areas which may contain conflict with the ICCPR, for example, ICAC powers, the Standing Orders of the Commissioner of Correctional Services, the detention of Vietnamese Boat People and the Official Secrets Acts. This exercise will continue during the proposed freeze period. Consideration of issues has also been given on new legislative and policy initiatives such as insider trading controls, electoral reform, the age of majority and controls on civil servants engaging in political activities.

Human Rights Commission

A number of representatons have suggested that a Human Rights Commission should be set up following the enactment of the Bill of Rights. The LegCo Ad Hoc Group also recommends the establishment of a Human Rights Commission, especially in view of the role such an institution may assume over the extension of the legal aid scheme, the handling of inter-citizen rights, and other benefits such an institution will bring about.
