13. No obligation to legislate forther in

respect of article 17

Article 17 does not require the enactment of further legislation in respect of that article.

14. No right to elected Executive or Legislative Council

Article 22 does not require the establishment of an elected Executive or Legislative Council in Hong Kong.

Explanatory Memorandum

The purpose of this Bill is to implement further the International Covenant on Civil and Political Rights (“ICCPR") as applied to Hong Kong by---

(a) making the rights recognized in the ICCPR part of the domestic

law, to be known as the Hong Kong Bill of Rights; and

(b) providing remedies in respect of a violation of any of those

rights.

2. Clause 2 is an interpretation provision. Amongst other things, it provides that, in interpreting and applying the Ordinance, regard shall be had to the fact that its purpose is to implement further the ICCPR.

Clause 3 provides that existing enactments shall, if possible, be construc consistently with the Hill. Those enactments that cannot be so construed are, to the extent of the inconsistency, repealed. These provisions come into operation 2 years after the commencement of the Ordinance resulting from the Bill. Other existing laws that are inconsistent with the Bill are immediately abrogated.

Clause 4 provides that subsequent enactments are, to the extent that this is possible, to be construed as being subject to the Bill.

Clause 5 provides that in time of public emergency which threatens the life of the nation and the existence of which is officially proclaimed, measures may be taken derogating from the Bill of Rights.

Clause 6 is concerned with the remedies in respect of a violation or threatened violation of the Bill of Rights. Clause 6(1) provides that a violation of the Bill of Rights is a tort (in respect of which damages may be awarded). Clause 6(2) provides that any court or tribunal may, in proceedings within its * jurisdiction, grant such remedy or relief, or make such order, in respect of a Bill 's violation as is within its powers and as it considers appropriate and

5. 草案第5條規定,在社會緊急狀態威脅到國家的生命並經正式宣布時,可採取刻 人權宣言所述權利的措施。

6. 草案第6條是關於違反或威脅違反人權宣言的補救。第6(1)條訂定,違反人權宜 屬侵權行為(可就該促推行為頒發租害賠償)。第6(2)條訂定,法庭或裁判所在其间访 推範圍內的訴訟中,可就違反人權宣言事件頒發認為公正適當且在其權力範圍內的 補救、請助或命令。
