Article 2--Right to Life
23. This Article requires that human life is to be respected and protected. No one can be put to death without a legal justification. The Article controls the use of the death penalty. It may be used only for the most serious crimes and not against children or pregnant women. There must be powers to commute a death sentence, to pardon someone sentenced to death and to grant an amnesty.
Article 3---No torture or inhuman treatment
24. Torture and degrading punishment are prohibited. No one can be subjected to medical or scientific experimentation without their agreement.
Article 4 - No slavery or servitude
25. The slave trade and slavery in all its forms are prohibited. So is forced labour. However some forms of compulsory work do not count as forced labour, for example, work by prisoners, members of the armed forces, and conscientious objectors.
Article 5-Liberty and security of person
26. This article guarantees everyone the freedom from arrest except under certain strict conditions. Only the law can specify the grounds on which a person may be arrested. Any person who is arrested must be told why, and if the person is charged with a crime that person must be given details of the charge. Any person charged with a crime must be taken promptly to a judge or person of similar authority. The arrested person is guaranteed the right to a trial within a reasonable time to see if a crime has been committed. Otherwise, the person must be released.
27. Anyone who is arrested or imprisoned may go to court to see if the law allows his arrest. If it does not, the court must have the power to let the person go free. Further, a person who is wrongfully arrested or imprisoned is entitled to be compensated.
Article 6-Rights of persons deprived of their liberty
28. Any person detained against his will must be treated humanely. The prison system must aim to reform prisoners. Any person who is accused of a crime should be kept separately from people who have been convicted. Minors should be kept separately from adults.
Article 7 No imprisonment for breach of contract
29. A person cannot be sent to jail for breaking a contract: for example, for not paying debts.
Article 8- Liberty of movement
30. All persons that the law permits to be in Hong Kong can travel and live where they like in Hong Kong. They can leave Hong Kong when they wish to do so. However, the law may restrict these freedoms when it is necessary for health, national security, public order or moral reasons, or when it is necessary to protect other people's freedoms. A person with a right of abode in Hong Kong cannot be prevented from entering Hong Kong except for good reasons.
Article 9-Restrictions on expulsion from Hong Kong
31. A person in Hong Kong without a right of abode can only be expelled from Hong Kong if a law provides for it and only if the procedures set out in the law are followed. Unless there are very important national security reasons, a person being expelled from Hong Kong can appeal against the expulsion.
Article 10---Equality before courts and right to fair and public hearing
32. Anyone who may become involved in a Court case must be treated equally and in an unbiased way. The case must be heard in public unless that would be unfair, an invasion of privacy, or for reasons of national security, public order, or for moral reasons. In any event, the decision of the Court must be made public except in certain cases where young people are involved, or in marriage or custody disputes.
Article 11--Rights of persons charged with or convicted of criminal offence
33. No one who is accused of a crime has to prove innocence. Guilt must be proven.
34. Any person accused of a crime is entitled:
(a) to be told what he is accused of;
(6) to be able to prepare a case against the accusation and choose a
lawyer;
