ARTICLE 2
DEFINITIONS
1.
(a)
For the purposes of this Agreement :
proceedings are instituted:
(i) in Hong Kong when a magistrate issues
warrant or summons, when a person is charged with an offence after having been taken into custody without a warrant, when a bill
bill of indictment is preferred; whichever is earliest in time.

"proceeds" means any property that is derived or realised, directly or indirectly, by any person from drug trafficking, or the value of any such property;
property includes money and all kinds of moveable or immoveable and tangible or intangible property;
"drug trafficking" means engaging or being concerned in the unlawful production, supply, possession for supply, transport, storage, import or export of a dangerous drug or assisting another to retain or dispose of the proceeds of drug trafficking,
drug whether in Hong Kong [ or elsewhere;
"dangerous drug" means any of the drugs or substances specified in Part I of the First Schedule to the Dangerous Drugs Ordinance Cap. 134 as amended from time to time for Hong Kong or in as amended from time to time for

the term "area" in relation to Hong Kong includes Hong Kong Island, Kowloon and the New Territories.
