ARTICLE IV
REFUSAL OR POSTPONEMENT OF ASSISTANCE
1.
Assistance shall be refused if the Central Authority of the
Requested Party determines that execution of a request:

[(a) would be contrary to the interests of justica; or]

would seriously impair the essential interests of the
Requested Party.

Assistance may be [refused or] postponed if execution of a request could prajudica an investigation or proceedings being conducted within the Requestad Party's jurisdiction for impose an excessive burdan on the resources of that Party).

[3. The Requestad Party may refuse assistance if the request
relates to an offenca which carries the death penalty in the Requesting Party but in respect of which the death penalty is not provided for in the Requested Party or is not normally carried out. Assistance may however be granted if the Requesting Party gives
such assurances as the Requested Party considers sufficient that the death penalty will not be imposed or if imposed not carried
