1. Thank you for your letter of 14 November to Miss Bailes (not copied to HKD or APA) who has now left Peking. It has taken us some time to obtain a response from the relevant section of the MFA, despite repeated prodding.
2. The MFA have said informally that they would require reciprocal arrangements as advised by your legal advisers (para 3 of your letter). They are however reluctant to commit themselves to a definite answer without seeing copies of the papers we received from the firm of Deacons in May, accompanied by a note setting out the views of your legal advisers and requesting in return their views on this matter. In order to proceed as the MFA wish, we would of course require Deacons' agreement. We would also be grateful for your views and those of HKD on this proposal.
3. We do not have at post any records of previous requests from the UK courts or from the PRC courts for enforcement of a judgement which would have implications as far as the Hong Kong courts are concerned. I am therefore copying this teleletter and previous correspondence on this matter to Ms Major in HKD for advice from the department's legal adviser on any known precedents. As you imply, the implications of enforcement of Chinese judgements in Hong Kong post-1997 will need any careful consideration.
