If UK courts have made such requests to the PRC authorities, which, as shown in the case of Deacons, include request for enforcement of a Hong Kong judgement in PRC and not just request for service of documents, it would seem to imply either of the following :

(i)

(ii)

that the UK courts are prepared to offer reciprocal assistance; or

that they do not consider such enforcement carries with it any undertaking to offer reciprocal assistance.

We would like to know which of the above is the case, and in this regard, I would be grateful if you could advise whether request for such judicial assistance (particularly request for enforcement of judgement) has been made by PRC to UK courts. It would also be very helpful if you could let us have a sample of such request from courts in the UK to the Chinese authorities, although, at the end of the day, we may not be able to follow the practice of UK courts due to special circumstances in Hong Kong.

Yours sincerely,

смелять
