OZONE LAYER PROTECTION ORDINANCE 1989

This Ordinance enables Hong Kong to comply with obligations imposed under the 1985 Vienna Convention for the Protection of the Ozone Layer and the 1987 Montreal Protocol on Substances that Deplete the Ozone Layer. It does so by controlling imports and exports of "scheduled substances" (chlorofluorocarbons and halons) through a registration and licensing scheme (sections 5 and 6).

The Ordinance prohibits the manufacture of scheduled substances (section 3) and enables regulations to be made for the control of products containing or made with scheduled substances, for the use of scheduled substances in a prescribed plant or process and for the use, recovery, recycling or disposal of scheduled substances (section 16).

The Ordinance affects the international legal obligations of the United Kingdom. Correspondence concerning the Montreal Protocol was exchanged between Foreign Commonwealth Office and Hong Kong Government during the past 2 years.
4. Before the Governor assented to the Bill in the name and on behalf of Her Majesty, the Attorney General advised that he could properly do so.
