HONG KONG: POST 1997 ARRANGEMENTS FOR WAR GRAVES

1. Please refer to Miss Rosalind Marsden's letter to you of 10 1... April. I am pleased to say that we have now received a response from the Hong Kong Government and are in a position to reply somewhat more fully to your letter of 17 January.

2. We are glad that you are able to agree

with the view that the security of land tenure in respect of Stanley and Sai Wan is protected by way of the two deeds of appropriation. The Hong Kong Government will be approaching the Land Commission along the lines proposed in the memorandum to which you refer in paragraph 3 of your letter.

3. Hong Kong have taken note of your concern that the Public Health and Urban Services Ordinance should be modified. They would be happy to enter into direct consultations with the Commission over this. I would suggest that, in the first instance, you contact Mr Clement Mak in Constitutional Affairs Branch of the Hong Kong Government. It would be helpful if you could send the initial correspondence to me for onward transmission to Hong Kong, but I would envisage no need for this department to be substantively involved.

Hong Kong have also noted your intention to manage your affairs in Hong Kong directly, without the use of an agent. look forward to hearing from you again on this point once you have considered further.

Finally, Hong Kong are giving further consideration to your proposal for a formal War Graves Agreement. I am afraid that we cannot say more at this stage, but I am sure you will appreciate that this aspect raises some complex issues.
