You will have seen from Hong Kong telegram no. 3679 that following the clearance by the Chinese of the Hong Kong/New Zealand and Hong Kong/Malaysia ASA texts, arrangements will shortly be set in hand for their signature. Hong Kong Department are arranging for a specific authorisation to sign each ASA to be issued to the Governor. But because the ASAS will enter into force upon signature, there also needs first to be an exchange of notes amending in each case the relevant UK ASA by removing the Hong Kong route.
In the case of New Zealand the draft text of the exchange of notes was agreed by the UK and New Zealand Governments and annexed to their Confidential Memorandum of Understanding of 22 March 1989. I enclose a copy of the draft. I should be grateful if you would instruct the High Commission in Wellington to effect this exchange as soon as possible.
In the case of Malaysia, the position is less advanced in that the text of the exchange of notes has been agreed only on an informal basis. I am trying to arrange for the necessary formalities to be completed as quickly as possible, and will be writing to you separately about that.
