ANIMALS AND PLANTS (PROTECTION OF ENDANGERED SPECIES) (EXEMPTION) (AMENDMENT) ORDER 1989
Made by the Governor under section 18
1. This order may be cited as the Animals and Plants (Prolection of Endangered Species (Exemption) (Amendment) Order 1989.
Interpretation
2. Paragraph IA(1) of the Animals and Plants (Protection of Endangered Species) (Exemption) Order Cap. 187 sub. leg.) is amended by repealing paragraph (u) of the definition of "personal effects" and substituting—
"(u) in the case of any tusk or part therent of Elephantidae species Elephants), being a manufactured product imported by any person and of which the Director s satisfied is not for the purpose of trace or business, not more than one kilogram thereof; or
taan in the case of any tusk or part thereof of Elephantidae species Elephants), being a manufactured product exported or intended for export by any person or otherwise in the possession or under the control of any person and of which the Director is satisfied is not for the purpose of trade or business, not more than 5 kilograms thereof; or".

3. Paragraph 4 is repealed.
Scheduled animal parts not exempted from sections 5 and 6
4. Part II of the Schedule is amended by adding after item 3
*3A. Any tusk or part thereof of Elephantidae species (Elephants).".

Explanatory Note
This order amends the Animals and Plants (Protection of Endangered Species) (Excmption) Order so that the present exemptions relating to persons exporting or being in possession of carved, polished or finished clephant tusks are narrowed. Licences will be required under sections 5 and 5 of the Ordinance in the case of persons exporting or being in possession of manufactured products of ivory other than those comprising personal effects not exceeding 5 kilograms.
