Please find attached a fax copy of the formal, signed, licence application from the ASIASAT consortium for a licence under the Outer Space Act 1986. We expect to have the actual application form from Hong Kong early next week, along with the additional enclosures referred to in Mr Seddon's letter of 1 March. Most recipients have already seen earlier documents relating to ASIASAT and it is hoped the details on the formal application form will give rise to no new significant difficulties. However I should be grateful of comments from recipients by 9 March as the launch remains scheduled for 7 April.

You should note that in this particular case the licence will not be issued on behalf of the Secretary of State but on behalf of (or by) the Governor of Hong Kong. The Act has been extended to Hong Kong in a manner to allow Hong Kong to take over licensing of Hong Kong based organisations. In this particular case BNSC are acting as agents for the Governor until adequate licensing arrangements are set up in Hong Kong which are acceptable to BNSC. Attached (Mr Hosker only) is a copy of the Order in Council and the Outer Space Act 1986 which it amends, which detail the exact manner of the Act's extension. I should be grateful if Mr Hosker would confirm this approach raises no new issues concerning contingent liability which may need to be reported to Parliament.
