ARTICLE 18
ALLOCATION OF LIABILITIES AND RISKS
Due to the special character of services related to the launching of a satellite, the Parties have agreed that the liability of CGWIC and of the Client arising from the defective, late or non-performance of CGWIC's Services or the Client's technical obligations is strictly limited to that expressly provided for in this Contract, to the exclusion of any other remedies, claims for damages or indemnities.
Except as provided in Paragraph 18.3 below, each Party shall bear any and all loss or damage to property or for bodily harm (including sickness and death) which it or its Associates may sustain in connection with or arising out of performance of this Contract without limit and without regard to the cause or causes thereof including without limitation the fault or negligence of either Party or of any of its Associates. Each Party irrevocably agrees to absorb the financial and any other consequences of such loss, damage or bodily harm on the principle of no fault, no subrogation and no recourse against the other and agrees that it shall not, through any means whatsoever, make or bring a claim against or sue the other Party or its Associates for such loss, damage or bodily harm or any and all consequences thereof.
Each Party shall be obligated to make an agreement with its Associates that the said Associates shall not, through any means whatsoever, make or bring a claim against or sue the other Party or its Associates for any loss, damage or bodily harm suffered by such Associates, and furthermore, each Party shall take all other reasonable steps to prevent claims for loss, damage or bodily harm from being made by its Associates against the other Party or its Associates.
In the event that one or more of a Party's Associates makes any claims or demand or instigates any proceeding
(whether administrative, arbitral, judicial or otherwise) against the other Party or its Associates on account of any loss, damage or bodily harm, the first Party shall indemnify and hold the other Party and its Associates harmless from any loss, damage, liability or expense, including reasonable attorney's fees, in connection with such loss, damage or bodily harm and shall dispose of and defend the other Party and its Associates from such claim, demand or proceeding, and
