Moreover each

Party shall nominate which of its employees and which of the employees of its Associates shall be entitled to have access to any such documentation.

Any copies or duplications of such documents and written information shall likewise be regarded as confidential and shall be subject to the same conditions regarding non-disclosure and use as are applicable to the original documents or information.

Unless a Party requires the return by the other Party of documents or written information provided to the other Party and provided that at such time there is no dispute or difference between the Parties which is or may be the subject of arbitration under Article 23 and no Reflight or Replacement Launch is then contemplated, the documents and written information and all copies thereof provided to the other Party shall be destroyed by the other Party. Such destruction shall not commence prior to the date falling 12 months after completion of a successful Launch or in any other case when agreed by the Parties. Either Party may at any time after the Launch require the return of any such documents or written information and all copies thereof and in the event that documents, written information and copies are to be destroyed may request that such destruction be witnessed or otherwise evidenced.

The above-mentioned confidentiality provisions shall remain valid after the termination of this Contract for whatever reason.

The obligations of the Parties under this Article shall not apply to documents or written information which:

are in the public domain or use;

shall become in public use, by publication or otherwise, and due to no fault of the receiving Party or any of its Associates;

the receiving Party can demonstrate were legally in its possession at the time of receipt;

are rightfully acquired by the receiving Party or its Associates from third parties;

are independently developed by the receiving Party or its Associates;
