ARTICLE 13
RIGHTS OF OWNERSHIP AND CUSTODY
The obligations of CGWIC pursuant to this Contract are limited to the Services and accordingly, the Client acknowledges that it shall not have any ownership rights or any other rights in or title to the Property of CGWIC or to any intellectual property or other intangible property of CGWIC or its Associates and shall not be entitled for any reason whatsoever to take or retain or seek the taking or retention of any Property of CGWIC and the Client shall waive any lien or other similar right to the Property of CGWIC.
CGWIC acknowledges that it shall not have any ownership rights or any other rights in or title to the Property of the Client or any of the intellectual property or other intangible property of the Client and its Associates and shall not be entitled for any reason whatsoever to take or retain or seek the taking or retention of any Property of the Client and CGWIC shall waive any lien or other similar right to the Property of the Client.
At all times during the implementation of this Contract, each Party shall be deemed to have custody and possession of the Property it is deemed to own.
At any time after Launch, CGWIC shall be entitled to destroy the Launch Vehicle and/or the Payload without any obligation to compensate the Client or its Associates for loss or damage to the Property of the Client, but without prejudice to any rights of the Client to a Reflight or cash refund under Article 11 hereof, in the event that such action shall be considered necessary by CGWIC, in its sole and absolute discretion, to avoid damage or injury to persons or property.
