LAUNCH POSTPONEMENTS

The postponement of the Launch Period, the Launch Slot, the Launch Day or the Launch Time except as otherwise provided herein shall be governed by the following provisions of this Article 10.

All requests for postponement of a Launch Period, a Launch Slot, a Launch Day or a Launch Time shall be made in writing and shall specify the Launch Period, Launch Slot, Launch Day or Launch Time proposed by the Client or CGWIC to replace the existing Launch Period, Launch Slot, Launch Day or Launch Time.

Postponements Requested by the Client

(a) Within 15 days of the receipt of a request for

postponement of the Launch Period, Launch Slot, Launch Day or Launch Time from the Client, CGWIC shall advise the Client by notice in writing whether a Launch Opportunity exists in the time period requested and that CGWIC accordingly accepts the time period proposed by the Client or CGWIC will propose a new time period which shall not in any event commence before the time period requested by the Client. The Client shall within 10 days of its receipt of the notice proposing a different time period advise if it accepts the proposal made by CGWIC.

(b) When proposing a new time period under

Sub-paragraph 10.3 (a), CGWIC shall have regard to the requirements of the Client for the Payload Mission, the technical needs and the interests of both CGWIC and the Client, any meteorological forecasts, and the time required to revalidate the launch system, if necessary. Any additional period of postponement proposed by CGWIC because of the unavailability of a Launch Opportunity within the time period requested by the Client shall be deemed a postponement requested by the Client, but if the additional period of postponement is requested for any other reason by CGWIC it shall be deemed a postponement requested by CGWIC.

(c) If the postponement requested by the Client meets

any of the following stipulations, no postponement fee shall be due from the Client:
